Is CBD Legal in All States?

Looking at The 2018 Farm Bill

In 2018, the federal government under President Trump’s administration did something amazing. The administration passed what’s known as the 2018 Farm Bill, which effectively removed industrial hemp from being classified as a Schedule I substance in the United States. This means that hemp-derived CBD that falls in line with the 2018 Farm Bill’s guidelines is legal in all states at the federal level.  This unprecedented move sent the CBD industry skyrocketing, expecting a growth of 706% by the Brightfield Group - hopefully reaching $23.7 billion by 2023.

Before the 2018 Farm Bill, hemp was technically legal in the United States, but under very strict conditions. Hemp was only grown under pilot programs that began in 2014, we didn’t have hemp cultivation facilities and farms like there are now. These pilot programs were incredibly restrictive, they didn’t really allow for just anyone to grow hemp. There are a lot of regulations and policies that those under a pilot program must follow, and they are also done through universities a lot of the time. The 2018 Farm Bill made hemp growing more inclusive and further propelled and shaped the American CBD industry that exists today.

Is CBD Legal in Idaho?

Just because the federal government creates a regulation, doesn’t mean states have to necessarily comply and enforce the regulations set forth by the federal government. States are allowed to create their own laws regarding CBD, and some states like Idaho forbid even a traceable amount of THC in CBD products.

While all hemp-derived products are required to contain less than 0.3% THC, full-spectrum extract CBD products will have a traceable amount of THC that falls under that 0.3% legal limit. Idaho forbids this at all, so they essentially do not allow full-spectrum extract CBD products. Idaho also has additional criteria before allowing a legal CBD sale, including what parts of the hemp plant can be used in the finished product, which is primarily mature stalks or sterilized seeds. Idaho does have CBD storefronts throughout the state, so the hemp industry is alive and well in the great potato state.

Also a heads up, Idaho is not the only state that has some gray area restrictions on CBD. South Dakota for example is one of the most unfriendly cannabis states in the whole country. Like Idaho, the restrictions are confusing and the state even has CBD storefronts in some places like Sioux Falls.

Is Marijuana Legal in All States?

In the cannabis and CBD industry, federal and state laws tend to collide way more than you’d imagine! This makes for confusing policy, gray area markets, and lots of unanswered questions. Even though the federal government is okay with hemp-derived CBD, the states are technically allowed to ban CBD or superimpose restrictions on the sale of it. Conversely, just because the states make marijuana legal, doesn’t mean the federal government is on the same page. Marijuana remains a Schedule I substance and is illegal at the federal level. The difference between hemp and marijuana is simply the THC levels, and marijuana is not legal in all states.
